Standards & Regulations

U websites are subject to certain State and Federal laws including FERPA, HIPAA, GRAMA, COPPA and ADA. In addition to existing statutes, Federal laws governing uniform internet accessibility standards are anticipated in the coming years.

Privacy (FERPA, HIPAA, GRAMA, COPPA)
 
  1. FERPA (Family Educational Rights and Privacy Act of 1974)
    A Federal Law designed to protect the privacy of a students educational records, and which provides students certain rights with respect to their educational records.   2. HIPAA (Health Insurance Portability and Accountability Act of 1996)
    Provides employees and the general public certain rights with respect to their health information. Details can be found at http://uuhsc.utah.edu/privacy
  3. GRAMA (Utah Government Access and Mgmt Act (Utah Code 63-2 et seq)
    While recognizing the public's right of access to information concerning the conduct of public business, the act also recognizes the right of privacy in relation to personal data gathered by governmental entities. http://www.le.state.ut.us/~code/TITLE63/63_01.htm
  4. COPPA (Children's Online Privacy Protection Act of 1998)
    Applies to the online collection of personal information from children under 13. The new rules spell out what a Web site operator must include in a privacy policy, when and how to seek verifiable consent from a parent and what responsibilities an operator has to protect children's privacy and safety online. http://www.ftc.gov/ogc/coppa1.htm

  1. Concepts (definition of web accessibility)
    The Americans with Disabilities Act of 1990 is being interpreted to include Web accessibility, even though no case law exists to expand the original language of the Law.
